???metadata.dc.description.resumo???: A expansão do Ensino Superior, aliada às políticas inclusivas de acesso ao Ensino Superior, como PROUNI, FIES e as políticas de cotas, tem permitido e facilitado o ingresso às faculdades e universidades do país por parte de novos públicos, oriundos de camadas sociais mais populares, inclusive, em cursos antes tidos como de alta seletividade, como o de Direito, e que tradicionalmente eram cursados por alunos provenientes das classes dominantes. Os cursos de Direito têm atraído um expressivo número de estudantes, considerando-se o número de matrículas, de concluintes e de vagas. A tese, de cunho documental, busca, utilizando-se como método o materialismo histórico dialético, demonstrar a tese de que, ao mesmo tempo em que um número cada vez maior de estudantes originários das camadas populares passou a ter acesso à formação em Direito, as elites profissionais do Direito, instaladas no órgão licenciador, nos tribunais e nas instâncias políticas passaram a condenar a ampliação do credenciamento de cursos e, para tanto, utilizaram-se de uma série de mecanismos de controle e limitação do acesso às carreiras jurídicas. Produz-se assim, um processo que Kuenzer (2005) denomina de "exclusão includente" e "inclusão excludente", ou seja, um movimento dialético que inclui estudantes de classes populares em um ensino superior em Direito sem as qualidades necessárias para sua formação humana e para o acesso às carreiras jurídicas, e, em contrapartida, exclui-os ou precariza as condições de suas relações no mercado de trabalho. A pesquisa tem como objetivos: a) analisar como ocorreu, no contexto das reformas do Ensino Superior, entre os anos 1995 e 2017, o processo de expansão da oferta dos cursos de Direito no Brasil; b) discutir se e como esses cursos desempenham o papel de atividade especializada dos Aparelhos Ideológicos de Estado (AIE) Escolar e Jurídico; c) refletir sobre as ações adotadas pela OAB e as alterações legislativas referentes aos cursos de Direito ocorridas a partir do seu processo de expansão, e seus possíveis reflexos sobre os egressos desses cursos, de origem popular, no acesso às carreiras jurídicas, especialmente na magistratura. A consecução da tese tem como suporte teórico dois importantes pensadores da vertente teórica crítico-reprodutivista, Louis Althusser e Pierre Bourdieu, que apesar de possuírem abordagens e métodos diversos, complementam-se, podendo-se, assim, fomentar o estabelecimento de uma epistemologia e análise crítica de suas teorias. Da pesquisa concluiu-se que, as disposições de classe dos estudantes, seus capitais culturais, econômicos e sociais, acabam por ser determinantes em suas trajetórias inclusivas ou excludentes no universo profissional das carreiras jurídicas, de modo que eventuais ingressos de sujeitos de classes populares em carreiras jurídicas, e em especial, na magistratura, são excepcionalidades determinadas por fatores e oportunidades que os colocam à parte da grande maioria dos sujeitos de sua classe, uma vez que a expansão da oferta de cursos de Direito reproduz ideologicamente o modo de produção capitalista, restringindo a margem de possibilidades desses sujeitos, aparentando, assim, ser uma política socialmente inclusiva, quando na realidade é excludente.
Abstract: The expansion of Higher Education, combined with inclusive access policies to Higher Education, such as PROUNI, FIES and quota policies has allowed and facilitated the entrance by new audiences to the country's colleges and universities, coming from more popular social strata even in courses previously considered highly selective, such as Law, and which were traditionally accomplished by students from the dominant classes. Law courses have attracted a significant number of students, considering the number of enrollments, graduates and vacancies. The thesis, of bibliographic nature, seeks, using the dialectical historical materialism as method, to demonstrate the thesis that, at the same time that an increasing number of students from the lower classes started to have access to qualification in Law, the professional elite of Law, installed in the licensing body, in the courts and in the political instances, started to condemn the expansion of the accreditation of courses and, for that, they used a series of mechanisms to control and limit access to legal careers. Thus, a process that Kuenzer (2005) calls "inclusive exclusion" and "exclusionary inclusion" is produced, in other words, a dialectical movement that includes students from popular classes in Higher Education in Law without the necessary qualities for their human formation and for access to legal careers, and, on the other hand, excludes or makes precarious the conditions of their relations in the labor market. The research aims to: a) analyze how happened, in the context of the Higher Education reforms, between the years 1995 and 2017, the expansion process of the offer of Law courses in Brazil; b) discuss whether and how these courses play the role of a specialized activity of the State and Ideological State Apparatuses (ISA); c) reflect on the actions adopted by the OAB (Brazilian Bar Association) and the legislative changes referring to the Law courses that occurred from its expansion process, and its possible reflexes on the graduates of these courses, of popular origin, in the access to legal careers, especially in the judiciary . The achievement of the thesis has as theoretical support two important thinkers from the critical-reproductive theoretical perspective, Louis Althusser and Pierre Bourdieu, who despite having different approaches and methods, complement each other, thus being able to foster the establishment of an epistemology and critical analysis of their theories. From the research it was concluded that the class dispositions of the students, their cultural, economic and social capital, are decisive in their inclusive or excluding trajectories in the professional universe of the legal careers, so that eventual entry of subjects from popular classes into legal careers, and especially in the judiciary, are exceptionalities determined by factors and opportunities that set them apart from the vast majority of subjects in their class, since the expansion of the offer of Law courses reproduces ideologically the capitalist mode of production, restricting the scope of possibilities of these subjects, thus appearing to be a socially inclusive policy, when in reality it is exclusive.
