A formação jurídica e as polêmicas sobre a oferta do curso de direito na modalidade EAD

Abstract

This dissertation brings the link between the areas of education and law, having as its object the study of the legal training of lawyers. One of the issues discussed in this work concerns face-to-face activities and whether they could be removed from the technical and practical training required by law students. So there is the research problem, which is, What factors affect the offer of the Law course in the distance modality? The general objective was to analyze the academic formation of the student of the Law course and the notes of the documents that deal with distance education in the Law course. As specific objectives, this dissertation proposed to carry out a survey of the main National Legislation and Regulations that establish the guiding guidelines of the Law course, as well as address the specifics of Distance Education linked to the professional training of the Bachelor of Law, in addition to addressing the legal position and guidelines , pedagogical and political regarding the authorization for the operation of the Law course in the distance education modality. For the construction of this dissertation, as a methodological path, a documental study was carried out, through the research of the set of petitions and judicial decisions in process before the Federal Court of the Federal District and the Federal Supreme Court. Since the Law course belongs to applied social science, which requires a correlation between theoretical knowledge and practical skills, it would be hampered by the offer of the course in the distance modality, even though face-to-face activities are mandatory, which would be insufficient to guarantee technical and practical training necessary for the academics of the law degree. From this perspective, it is not a question of conservatism or the closing of an educational system, but a concern with the quality of legal courses.
