Divórcio destrutivo no contexto da justiça

Abstract

This dissertation consists of two articles. The first is an integrative review of destructive divorce in the context of justice. 25 articles were selected with the aim of analyzing how this topic has been addressed in national and international literature, from 2000 to 2021, using the Prisma method. It is concluded that destructive divorce was studied under several aspects, emerging 3 themes: family relationships; therapeutic interventions; and, legal interventions. There is unanimous agreement on the severity of parental conflict in the developmental process of children, as well as the need for more effective interventions aimed at guaranteeing children’s rights. As for the decision about the type of custody that best meets the needs of the children in these cases, it was not possible to reach a conclusion. New research is needed that addresses clinical practice and the elaboration of guidelines for the psychological care of these judicialized families. The second article is empirical research that aimed to analyze the therapeutic resources used by systemic family therapists in the context of destructive divorce. Seven family therapists were interviewed remotely. The instruments used were a questionnaire and a semi-structured interview and the content analysis resulted in 3 categories: context of assistance to families in destructive divorce, therapeutic resources used in the session and therapeutic resources beyond the session. The results show different sources of forwarding these cases, but there was agreement when emphasizing the importance of legal operators acting cooperatively. The characteristics of the cases attended were cited, the therapeutic resources 10 used in the sessions, and it was possible to understand how the therapists carry out their clinical practice in the judicial context. This research highlighted the need for new studies with the aim of evaluating the systemic practice and its effectiveness in this judicial context, as well as new studies focused on the production of documents. The results of both studies reflect the need to develop clinical and therapeutic strategies for the adequate management of this demand, as well as teamwork with legal professionals so that the family can adhere to the process.
