Abstract: The main predictor for criminal behavior is crime committed by family members. This study aimed to compare family infraction history of convicts and university students and to evaluate the intergenerational transmission and predictor variables of criminal behavior. The study was conducted with 791 adult individuals, almost half of them being convicts and the other part university students of both genders. Participants replied to the Criminal Family History Inventory (CFHI), to the Parental Styles Inventory (PSI) and to a socioeconomic questionnaire. Most serious crimes were identified in the families of the convicts: theft (χ2 = 41,137; p < 0,001), robbery (χ2 = 96,363, p < 0,001), homicide or homicide attempt (χ2 = 60,363; p < 0,001), illegal possession of gun (χ2 = 83,693; p < 0,001), drug trafficking (χ2 = 83,196; p < 0,001), receiving (χ2 = 62,151; p < 0,001), domestic violence (χ2 = 18,449; p < 0,010) and body injury (χ2 = 18,526; p < 0,010). There were significant and positive correlations between family members and offences committed. The risk factors differentiated between groups: the convicts grew in violent neighborhoods (χ2 = 85.33; p < 0.001), lived with deviant pairs (χ2 = 30.72; p < 0.001) and were created by parents with low educational level, who used negative parent practices more often than the parents of university students. Multiple linear regression identified that the influence of deviant pairs, neighborhood, low mother educational level and negative parental practices are risk factors and predictors of criminal behavior, while adequate housing and positive parental practices are protective factors (F (4, 559) = 50,062; p < 0.001; R2 = 0.26). The negative parental practices "maternal negative monitoring", "maternal inconsistent punishment" and "paternal neglect" are risk factors for criminal behavior while the positive practices "maternal moral behavior" and "positive paternal positive monitoring" are protective factors (F (5,626) = 24,225; p < 0.001; R2 = 0.16). Risk and protection factors, as well as the correlation between infractions and family members, showed the intergenerational transmission of infringing behavior. Discussion of public policies to inhibit the progression and maintenance of infringing behavior are discussed.
